There’s a few variables here…
If they throw their hand into the muck, they fold and they lose. If they simply turn their hand over where it is and say they lose, but are actually winning and they have not tossed their cards in the muck, then their hand is still live but it would be up to the player or the dealer to catch the mistake.

It boils down to what happens to the tossed cards. If they touch the muck pile of discarded cards (dealer burned cards, undealt cards, or other folded cards) then the hand is dead. Once those cards touch the muck it’s all over.
If the cards do not touch the muck and someone spots the mistake, the player can still win. Saying that he lost does not mean that he has.

since you said the cards were fliped face up, they win that pot because the cards speak for them self, as long as they are fliped face up, if they threw them in face down then that’s a mucked hand and the other player wins the pot, {it does not matter whether they touch the muck as long as they are face up}
